Terms of Service

You must be at least 18 years old and legally able to enter this agreement. Keep your login credentials private, provide accurate information, and tell us promptly if you believe your account has been compromised. You are responsible for activity performed through your account.

CheekyAI provides general fitness, nutrition, habit, and movement information. It is not medical care, diagnosis, treatment, physical therapy, or emergency advice, and it does not create a clinician-patient relationship. The Service cannot evaluate every injury, medication, pregnancy, medical condition, or individual risk.

Consult a qualified healthcare professional before beginning or changing an exercise or nutrition plan, especially if you have an injury, health condition, are pregnant or postpartum, or have been advised to limit activity. Use safe equipment and appropriate supervision. Stop exercising and seek appropriate help if you experience pain, faintness, chest discomfort, unusual shortness of breath, or another concerning symptom. Call local emergency services for an emergency.

Some coaching, form feedback, meal estimates, summaries, and plan suggestions are produced with automated systems. AI can misunderstand context and can return inaccurate, incomplete, or unsuitable guidance. It is not a human coach or healthcare professional. Review recommendations before acting on them and use your own judgment. Form-check and progress tools are aids, not guarantees of technique, safety, or results.

A free trial begins only after you complete Stripe Checkout and add a payment method. The trial length, recurring price, currency, billing interval, and any valid promotion are shown at checkout. Unless you cancel before the trial ends, Stripe charges the displayed subscription price when the trial converts. Subscriptions then renew automatically at the interval shown until canceled.

You can review or cancel through the billing portal linked from Settings. Cancel before the date shown there to avoid the next charge. Cancellation normally takes effect at the end of the current trial or paid billing period unless the portal says otherwise. Promotional codes are subject to their stated eligibility and duration. Taxes and payment-method rules may apply. Refund rights, if any, depend on applicable law and the circumstances; contact us promptly about a billing error.

You retain your rights in the workout data, messages, photos, videos, voice transcripts, and other content you submit. You give us a limited permission to host, process, reproduce, and transmit that content only as needed to operate, secure, support, and improve the Service and to provide the features you request. You represent that you have the rights and consents needed for anything you upload. Do not upload another person's image, voice, health information, or private material without permission.

The Service, including its software, design, branding, program presentation, and original content, is owned by CheekyAI or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own fitness and nutrition purposes. This license does not transfer ownership or permit commercial resale, redistribution, copying of the Service, or use of CheekyAI branding without permission.

You may not use the Service to:

• break the law, harm or harass someone, or violate another person's privacy or rights;
• upload malware, abusive material, or content you do not have permission to use;
• probe, disrupt, overload, scrape, or bypass security, access controls, quotas, or billing;
• reverse engineer the Service except where applicable law expressly permits it; or
• use automated output as medical advice or to make high-impact decisions about another person.

We may restrict or suspend access when reasonably necessary to protect users, the Service, or others.

You may stop using the Service, cancel renewal, or request account deletion at any time. We may suspend or terminate access for a material breach of these Terms, nonpayment, fraud, abuse, legal requirements, or a credible risk to users or the Service. Where reasonably possible, we will provide notice and an opportunity to resolve the issue. Termination ends your license to use the Service but does not erase payment obligations already incurred or provisions that by their nature should survive, including ownership, disclaimers, liability limits, and dispute-related rights.

Settings includes tools to export supported account data and request permanent account deletion. A deletion request may revoke access immediately and cannot be undone once processing begins. Provider cleanup, security records, payment records, and backups may take additional time or be retained where reasonably necessary for fraud prevention, dispute resolution, legal obligations, or system recovery, as described in the Privacy Policy.

We may update, add, remove, or discontinue features and may impose reasonable usage limits. We work to keep the Service available, but do not promise uninterrupted or error-free operation. You are responsible for maintaining compatible devices, internet access, and safe copies of information you need outside the Service.

To the extent permitted by law, the Service is provided “as is” and “as available.” We do not guarantee a particular fitness, health, aesthetic, or financial result. Exercise and dietary changes involve inherent risks, and you remain responsible for deciding whether and how to participate. Nothing in these Terms limits rights or remedies that cannot legally be limited, including mandatory consumer protections.

To the extent permitted by law, CheekyAI and its service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from the Service. To the extent a monetary limit is legally permitted, aggregate liability arising from the Service will not exceed the greater of US $100 or the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be excluded or limited, including any mandatory rights relating to fraud, willful misconduct, or personal injury.

We may revise these Terms as the Service changes. We will post the updated version and effective date and, when a change is material, provide additional notice where reasonably appropriate. Continued use after a revised version takes effect means you accept the revised Terms where permitted by law.
